IR35 reform in the Private Sector

In April 2017, in the Public Sector, the Government made a significant change to IR35, moving the employment status assessment obligation, and therefore the tax risk, from the worker to the end hirer. This has had a significant impact upon Public Sector hirers, agencies and contractors. This year, the Government carried out a Consultation to consider whether it should make the same or similar changes in the Private Sector. We expect to hear the outcome of that Consultation soon.

The Brookson Group has spent over 20 years supporting the contracting sector and, for the past 18 months, we have also supported our Public Sector clients with the changes made in April 2017. Since the Private Sector Consultation was announced, we have been meeting with agencies and hirers to discuss what we think will happen in the Private Sector and how we can help. In particular, we have been helping agencies to help their clients get ready for significant change to IR35 in the Private Sector, through education, audits, processes, policies and ongoing support.
